TERMS & CONDITIONS

 

Horse Health Requirements

Health certificates and negative Coggins for transport will be the responsibility of buyer. All normal vaccinations and worming on sale horses will be up to date as of June 15th, 2009, and buyers will be provided with current health records for each horse.

 

Registrations

All sale horses will be registered with the American Morgan Horse Association. All buyers will receive original registration papers signed for transfer upon receipt of payment in full, as well as a Bill of Sale. Any transfer fees will be the responsibility of the buyer. Buyers: All sales are final. The seller guarantees the identity of each animal as it appears on the registration certificate. Title passes at the conclusion of the sale on midnight Pacific Coast Time, June 15, 2009, to the last and highest bid received before that time and date, to be determined by e-mail stamp, at which time all risk and responsibility for the horse passes to the buyer.

 

Terms

No horse will be allowed to leave Dragonfire Morgans without full payment. All horses must be removed from Dragonfire Morgans, Wilton, CA no later than 6:00 pm, June 20, 2009, unless otherwise arranged in writing between Dragonfire and buyer. Madison Avenue Morgans reserves the right to remove from this auction any horses for any reason prior to the ending time and date of the auction on midnight, June 15, 2009.

 

BuyerŐs Payment

Buyer shall pay for the horse(s) no later than 6:00 pm on Saturday, June 20th, 2009 by one or more of the following means: cash, approved personal check (with letter from bank guaranteeing payment), money order, wire transfer, cashierŐs check, or travelers check. US funds only. Checks are to be made payable to Madison Avenue Morgans. There will be a $75 service charge applied to all bad checks (NSF, Stop Payment, etc.). NOTE: Horses may not leave Dragonfire until bank confirms all checks as cleared.

 

Warranties

Ages, heights, markings and physical conditions are approximated and not guaranteed. It is the responsibility and obligation of the buyer to examine the horse before he bids, as all sales will be final. In the case of the discovery of typographical errors or other errors, corrections will be made on the website promptly. Buyers are therefore encouraged to make an appointment to visit Dragonfire Morgans to inspect the horses in person. Buyers are welcome and encouraged to have any sale horse vetted for pre-purchase, provided arrangements to do so are made through Dragonfire at their convenience, and the veterinary examination is paid for by the buyer and exam is performed prior to closing date of auction, Midnight on June 15, 2009.

 

Guarantees

No guarantees whatsoever, expressed or implied, are made by Madison Avenue Morgans, Sandra Nelson, Dragonfire Morgans, Masterworks, or anyone associated with the Madison Avenue Morgans 2009 AMHA Benefit Auction as to title, quality, unsoundness or soundness of any consignments. All horses are sold strictly Ňas isÓ, at the buyerŐs sole risk.

 

No Liabilities

Madison Avenue Morgans, Dragonfire Morgans, Masterworks, and all those associated with the auction

in any way shall not be liable for any injuries sustained by anyone inspecting auction horses at Dragonfire Morgans, and all parties entering the grounds of Dragonfire Morgans do so at their own risk, and further

release the organizers of this sale from any liability or responsibility for any injuries sustained by them during such visits or any related activities from any cause whatsoever.
